Abstract:
ریسک های سیاسی مانع مهمی در مسیر سرمایه‌گذاری مستقیم خارجی به شمار می روند و ریسکهای مربوط به ارز یکی از اهم این ریسکها می باشند. تبدیل ناپذیری، انتقال ناپذیری و نوسان نرخ ارز اتفاقاتی هستند که ممکن است منافع سرمایه‌گذار خارجی را به شدت متأثر سازد. پوشش بیمهای این ریسکها راهکاری برای مدیریت آنها و ترغیب سرمایه گذار خارجی است. بررسی امکان پوشش بیمهای این ریسک ها و رویکرد ایران در این خصوص، هدف از نگاشتن این مقاله است. ریسک تبدیل ناپذیری ارز و عدم قابلیت انتقال آن، در زمره ریسک‌هایی هستند که تحت پوشش بیمه ریسک سیاسی قرار می گیرند، لکن ریسک نوسان نرخ ارز را به دشواری می توان در شمار ریسکهای بیمه‌پذیر تلقی نمود. بر این مبنا آیین‌نامه موسوم به آیین نامه شماره 70 در خصوص پوشش بیمهای نوسانات نرخ ارز توسط شرکتهای بیمه چندان با اقبال مواجه نگردیده است.اگر چه بالغ بر یک دهه است که در حقوق ما سخن از بیمه ریسک نوسان نرخ ارز به میان آمده است؛ لکن با توجه به ماهیت ریسک مزبور، پوشش آن در قالب بیمه معمول شرکتهای بیمه چندان محملی ندارد و مدیریت ریسک مزبور از طریق اوراق مشتقه با تقویت زیرساختهای آن در کشور میسورتر و منطبق با رویکرد جهانی است.در این نوشتار با اتکا بر روش کتابخانه‌ای و با رویکرد تحلیلی و کاربردی سعی بر توصیف مفاهیم، معرفی و تبیین موضوع علی الخصوص با توجه به بداعت موضوع بیمه ریسک سیاسی در نظام حقوقی ایران گردیده است
Political risks are an important obstacle in the way of foreign investment and currency-related risks are one of the most important of these risks. Inconvertibility, non-transferability and exchange rate fluctuations are events that may severely affect the interests of foreign investors. Insurance coverage of these risks is a way to manage them and encourage foreign investors. The purpose of writing this article is to examine the possibility of insurance coverage of these risks and Iran's approach in this regard. Currency inconvertibility and non-transferability risks are among the risks covered by political risk insurance, but the risk of exchange rate fluctuations can hardly be considered as insurable risks. Based on this, the regulation called Regulation No. 70 regarding insurance coverage of exchange rate fluctuations by insurance companies has not been very successfulAlthough it is over a decade that the exchange rate risk insurance has been posed in our legal system, it’s coverage in the form of regular insurance by insurance companies seems hard to accept due to the nature of this risk. Indeed, management of the risk by derivatives trough Strengthen required infrastructure or coverage of Export Guarantee Fund seems more procurable and homogeneous with global approach in this regards. In this essay, relying on the library method and with a descriptive and practical approach, an attempt has been made to delineate the concepts, introduce and explain the subject, especially with regard to the novelty of political risk insurance in the Iranian legal system.
