Abstract:
تغییر اقلیم و آثار سوء ناشی از آن نظیر آب شدن یخچال‌های طبیعی، افزایش سطح آب اقیانوس‌ها و وسعت گرفتن زمین‌های خشک و بیابانی، پیامدهایی است که امروزه در اقصی نقاط جهان قابل مشاهده و رو به فزونی است. چنین پیامدهایی حتی به‌رغم پایبندی به پیش‌بینی‌های به‌عمل‌آمده در قالب رژیم حقوقی تغییر اقلیم (تعهدات مندرج در کنوانسیون چارچوب سازمان ملل متحد مصوب 1992، پروتکل 1997 کیوتو و توافقنامۀ 2015 پاریس) باز هم قابل وقوع بوده و هستند. به همین سبب، از همان ابتدای شکل‌گیری کنوانسیون چارچوب تغییر اقلیم، مقولۀ «ضرر و زیان‌های همراه با آثار سوء تغییر اقلیم» نیز از سوی اعضای کنوانسیون به‌ویژه کشورهای در حال توسعه مورد توجه قرار گرفت. با وجود تلاش‌های صورت‌گرفته جهت تبدیل مفهوم «ضرر و زیان» به مبنایی به‌منظور جبران خسارت و «مسئولیت بین‌المللی» در قبال تغییر اقلیم، این اصطلاح ماهیت ویژه‌ای به خود گرفته و هم در اسناد بین‌المللی ناظر بر تغییر اقلیم و هم در ادبیات حقوقی، توضیح مفهوم آن با ابهام‌های زیادی مواجه شده است. ابهام‌هایی در حوزه‌های معناشناختی، حقوقی و فنی/تخصصی از مفهوم «ضرر و زیان» که تعامل آن با نظام مسئولیت بین‌المللی را تحت‌الشعاع قرار می‌دهد و وضعیت فعلی و آتی مسئولیت بین‌المللی در قبال تغییر اقلیم را قابل بحث و تفسیر باقی می‌گذارد.
Today, climate change and its adverse effects - such as glacial retreat, sea-level rise, and desertification - are increasingly evident around the world. Such adverse effects may continue to occur despite the implementation of the climate change legal regime, namely: the obligations under the UN Framework Convention on Climate Change 1992, the 1997 Kyoto Protocol and the 2015 Paris Agreement. As a result, from the time of the 1992 Convention’s adoption, the issue of “loss and damage associated with the effects of climate change impacts" was emphasized by its member states, especially the developing countries. Despite the efforts to turn "loss and damage" into a basis for reparation and international responsibility/liability for climate change, this concept has taken on a special character. Consequently, international instruments and legal literatue on climate change are unclear about meaning of “loss and damage”. Furthermore, these terminological, legal and technical ambiguities overshadow its interaction with the international responsibility/liability system and make the current and future status of international responsibility for climate change controversial.

ازاين رو يکي از اصلي ترين سؤالات مطرح شده در مذاکرات پاريس اين بـود که آيا سازوکار ورشو براي پاسخگويي به ضرر و زيان هاي همراه بـا تغييـر اقلـيم کـافي اسـت يـا لازم است سازوکار جديدي پيش بيني شود؟ آيا لازم است موضوع ضرر و زيان در ماده اي جداگانـه مطـرح شود يا همراه با تعهد به سازگاري؟ طرح مقولۀ مسئوليت در قبال تغييـر اقلـيم بهتـر و ثمـربخش تـر است يا سـکوت در قبـال آن (١١٨ :٢٠١٦ ,Burkett)؟ نتيجـه اي کـه در نهايـت حاصـل شـد، حفـظ سازوکار ورشو در مـادة ٨ توافـق پـاريس ، روشـنگري پـاراگراف ٤٧ تـا ٥١ تصـميم بيسـت ويکمـين کنفرانس اعضاي سال ٢٠١٦ در خصوص موضوع ضـرر و زيـان ١ و عـدم طـرح موضـوع مسـئوليت و جبران خسارت در توافق پاريس بود.
