Abstract:

Sexual acts beyond the prescribed limits are considered immoral in different societies، and members of society usually resist against them. Indicating the proper lifestyle in different aspects towards reaching perfection، the religion of Islam has prescribed certain punishments for these heinous acts. Two examples of the heinous acts are adultery and rape. One of the issues raised in the ways of establishing the offence of adultery is neglecting the rights of victims in rape. The reason is that the divine legislator has made the ways of establishing this offence extremely hard due to preservation of certain interests in the life of human beings. Thus the rights of victims of rape are trampled. Studying the Islamic procedure in establishing crimes committed against God and those committed against people and clarifying the concepts of adultery and rape based on Islamic traditions، the present article explains the difference between them and argues that following this distinction، the process of establishing adultery which requires mutual consent is different from rape.

"حکمی که در زنای ناشی از رضایت طرفین وجود ندارد؛ چرا که در آنجا زن بغی محسوب می‌شود و طبق روایت منتسب از حضرت رسول اکرم(ص) به این فرد مهر تعلق نمی‌گیرد «لا مهر لبغی» اما در خصوص تجاوز به عنف از آن‌جایی که زن رضایت نداشته است، تفویت بضع وی موجب استقرار مهرالمثل برای او می‌باشد که در کلام برخی فقها نیز به آن اشاره شده است. موضوع رسیدگی به پرونده‌های زنا و تجاوز به عنف به طور مستقیم در دادگاه مربوطه در قسمت بعد مورد بررسی قرار خواهد گرفت، ولی در خصوص تحقیق در جرائم منافی عفت، چنان‌چه مشاهده می‌شود قاضی از تحقیق منع شده است، مگر این‌که جرم مشهود بوده یا دارای شاکی خصوصی باشد. برخی از فقهای معاصر نیز در این مورد روایاتی را مطرح می‌کنند که نشان‌دهنده این مطلب است که قاضی در حدود و بالاخص در زنا نمی‌تواند به علم خود عمل کند(هاشمی شاهرودی، 1376، صص 100-110) که مخصوصا در باب زنا و لواط که با چهار نفر ثابت می‌شوند، به نظر به ثواب نزدیک‌تر می‌باشد؛ چرا که عقل بشری می‌داند که اگر کسی یک بار یا دو بار یا سه بار اقرار نمود، علم حاصل می‌شود و در جایی که قرار باشد با اقرار، علم ثابت شود، دیگر نیازی به چهار اقرار نیست، ولی از روح شرع بر می‌آید که چنین حدی باید با چهار بار اقرار صورت گیرد."
