Abstract:
پولشویی، فرایندی بزهکارانه است که درجریان آن عواید ناشی از فعالیت های مجرمانه درمسیرهای قانونی قرارمیگیرد وبه ظاهرتطهیر وپاک می شود؛فرایندی که آثارجبران ناپذیری را بر پیکره سیاسی، اقتصادی، اجتماعی و فرهنگی جامعه برجای می گذارد؛ هم پیوندی نزدیک واشکارپدیده پول شویی با فعالیت های بزهکارانه و نقش اساسیآن درترغیب یا تسهیل فعالیتهای بزهکاران و امکان تداوم یا تقویت جرایم سازمان یافته، اهمیت شناسایی و رویارویی با این پدیده شوم و ایجاد عزم جهانی را برای مبارزه با این معضل- به ویژه ازدهه 1980 به این سو- دو چندان ساخته است.در اواخراین دهه پیمان نام هها وکنوانسیون هایی به منظورمقابله با پول شویی تدوین شدند، که یکی ازمهمترین آنها، کنوانسیون ملل متحد برای مبارزه با فساد(مریدا) مصوب سال( 2003 ) میلادی می باشد.درسطح ملی نیزبسیاری ازکشورها قوانین ضدپولشویی موثری را به تصویب رساندند.درایران نیز، همپا با تحولات بین المللی درخصوص مبارزه با پول شویی اقدامهایی صورت گرفته است که نمونه بارز آن، قانون مبارزه با پول شویی مصوب سال 1386 مجلس شورای اسلامی است. در این مقاله ضمن بررسی انتقادی بعدکیفری قانون مبارزه با پول شویی با تکیه برمقررات کنوانسیون سازمان ملل متحد برای مبارزه با فساد (که جمهوری اسامی ایران درتاریخ 1387/8/14 به این کنوانسیون ملحق شده است) سعی شده است که به سوالاتی از قبیل اینکه آیا ضمانت اجرای مقرردرقانون مبارزه با پول شویی متناسب با جرم پول شویی می باشد؟ آیا قانون گذارعلاوه برجرم انگاری پولشویی، مصادیق دیگری را مانند شروع، شرکت و معاونت در جرم پول شویی را نیزجرم انگاری کرده است؟ چه انتقاداتی بر این قانون از حیث بعد کیفری آن وارد است؟ پاسخ داده شود.
Money laundering is a criminal process which during the benefits from criminal
activities justifies regulatory pathways and apparently it is purified and clean;
the process that leaves irreversible effects on bodies of the political, economic, social
and cultural. Clear and close similarity to the money laundering phenomenon with
criminal activities, and its fundamental role in encouraging or facilitating criminal
activities and to sustain or strengthen organized crime, the importance of identifying
and dealing with this phenomenon and a global commitment to combat this problem
- Especially since the 1980s - has made doubled. At the end of this decade, treaties and
conventions have been developed to combat money laundering that one of the most important
of them is United Nations Convention against Corruption (Merida), enacted in
2003. At the national level, many countries have enacted anti-money laundering laws.
In Iran along with international developments concerning to combat money laundering,
actions has been that one obvious example is Law Anti-Money Laundering approved
of Parliament in 1386. This paper critically reviews the criminal law to combat
money laundering relying on the provisions of the UN Convention against Corruption
(Which Iran has signed the convention on 8/14/1387), Try to be answered questions
such as whether it is provided by law enforcement to fight crime, money laundering,
money laundering is appropriate? Is legislature, In addition to the criminalization of
money laundering, examples such as starting a company and abetting money laundering
has also criminalized? What criticisms of the criminal law are being followed?
